Before we begin, here are a few thoughts on handling our products. We deal in sophisticated and delicate works of art. Therefore, we would like to point out the following: Photographs, art prints, and all other artworks are constantly exposed to environmental influences. For example, their appearance and color can change. To ensure you enjoy our artwork for years to come, you should not expose them, either partially or completely, to direct sunlight, hang them directly above radiators, or expose them to humidity levels exceeding those of normal living spaces. Photographs, prints, mounts, and frames are therefore not suitable for outdoor use, basements, or bathrooms. Mounts with UV-protective film or acrylic glass and wooden frames are very susceptible to scratches and stains and should therefore only be handled with gloves or similar protection.

Our terms and conditions aim to regulate the business relationship between you and us in a binding and fair manner. Therefore, the basis of every order and contract is always the following General Terms and Conditions of Fotoverlag Romstorfer e.U., which you acknowledge and accept by placing an order with us. § 1 Scope
The following General Terms and Conditions, in their version valid at the time of the order, apply exclusively to the business relationship between Fotoverlag Romstorfer e.U. (hereinafter referred to as Fotoverlag Romstorfer) and the customer. Fotoverlag Romstorfer does not recognize any conflicting terms and conditions of the customer unless Fotoverlag Romstorfer has expressly agreed to their validity in writing.
§ 2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. The products you have selected via the “Add to Cart” button will be summarized for you in an order overview at the end of the ordering process. Here you can review all the information you have entered during the ordering process and add to or correct it using the “Edit” button. By clicking the “Place Order” button, you submit your order data and make a binding declaration to Fotoverlag Romstorfer that you wish to purchase the listed products (offer). We automatically accept your offer upon receipt of your order. Immediately after submitting your order, you will receive an order and contract confirmation by email, which lists the details of your order again.
The text of your order will be saved by us and can be sent to you upon request after your order is completed. For your own records, Fotoverlag Romstorfer recommends that you print out the order details and the terms and conditions in effect at the time of ordering.
If you have set up a user account in the online shop Fotoverlag Romstorfer before submitting your order, the order data will be archived on the website and can be accessed by you via your password-protected user account using the corresponding login details.
This does not affect the consumer’s right to receive the information specified in Section 4 Paragraph 1 of the Distance Selling Act (FAGG) on a durable medium within a reasonable period after conclusion of the contract. The contract language is German.
Order processing and communication generally take place via email and automated order processing. Therefore, you must ensure that the email address you provide for order processing is correct so that you can receive emails sent by Romstorfer Photo Publishing. In particular, if you use spam filters, you must ensure that all emails sent by Romstorfer Photo Publishing or by third parties commissioned by them to process orders are delivered.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.
The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 4 Prices, Due Date and Payment, Default
Unless otherwise stated in the product description, the prices quoted are total prices, including statutory VAT. Any applicable delivery and shipping costs will be listed separately in the respective product description.
For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, which are beyond our control and must be borne by you. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties and taxes (e.g., customs duties). Such costs may also be incurred with regard to money transfers even if the delivery is not made to a country outside the European Union, but you make the payment from a country outside the European Union.

If advance payment by bank transfer is agreed, payment is due immediately after conclusion of the contract, unless you have agreed a later due date with us.

§ 5 Delivery
Unless otherwise agreed, delivery will be made from our warehouse to your address or to the delivery address you have specified.
If the shipping company returns the goods to Fotoverlag Romstorfer because delivery to you or the alternative recipient was not possible, you will bear the costs of the unsuccessful shipment. This does not apply if you are not responsible for the circumstances that led to the delivery failure or if you were temporarily prevented from accepting the offered service. Furthermore, this does not apply to the initial shipping costs if you effectively exercise your right of withdrawal. Regarding return shipping costs, the regulations set forth in Fotoverlag Romstorfer’s cancellation policy apply if you effectively exercise your right of withdrawal.
For self-collection, the Fotoverlag Romstorfer will first inform you by email that your order is ready for pickup. After receiving this email, you can collect the goods by prior arrangement at our store: Fotoverlag Romstorfer, Europaring F11, 2345 Brunn am Gebirge, Austria. In this case, no shipping costs will be charged.

§ 7 Warranty
If the purchased item is defective, the provisions of the statutory warranty for defects apply.
We kindly ask you to report any delivered goods with obvious transport damage to the delivery driver and to inform us by E-Mail shop@fotoverlag.eu or by phone at +43 664 5151435. Failure to do so will not affect your statutory or contractual warranty rights.
§ 8 No granting of rights
By purchasing our images, prints, or photographic prints, you acquire only the physical ownership of the work. No other rights of use are granted. Any reproduction, distribution, rental, public display, or other analog or digital exploitation is prohibited unless permitted by law. You may, however, resell the images, prints, or photographic prints.
§ 9 Collection, processing and use of personal data
All regulations regarding the protection of your data can be found on our homepage under Privacy Policy.
§ 10 Applicable Law
This contract is governed by Austrian substantive law; the application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
The court with subject-matter jurisdiction at the registered office of our company shall have local jurisdiction to decide all disputes arising from this contract. However, we also reserve the right to bring legal action at the general place of jurisdiction of the other party.
